What is a testamentary trust and should I have one?
A testamentary trust is established by your will and comes into effect after death. It can provide tax advantages, asset protection, and greater control over distributions -particularly useful for families with minor children or significant assets.
What happens if someone dies without a will in Victoria?
The estate is distributed according to a statutory formula under the Administration and Probate Act 1958 -which may not align with the deceased’s wishes and can create delays and family disputes.
What is the role of an executor?
An executor administers your estate after death -obtaining probate, identifying assets, paying debts, managing tax obligations, and distributing the estate to beneficiaries.
Can someone challenge my will after I die?
