Do I need a lawyer for a divorce in Australia?

While it’s possible to apply without a lawyer, legal advice is strongly recommended if there are parenting or property matters. Divorce itself is straightforward, but associated arrangements require careful guidance.

Property settlement involves identifying the asset pool, assessing contributions, considering future needs, and determining a just and equitable division. There is no automatic 50/50 split.

A BFA sets out how assets and finances will be divided in the event of separation. It can be entered before, during, or after a relationship. Both parties must receive independent legal advice.

Parenting arrangements are decided based on the best interests of the child. Factors include the benefit of a meaningful relationship with both parents, the child’s views, and each parent’s capacity.

An agreed settlement can be finalised in 2–6 months, while contested matters may take 12–24 months or longer.
